August 21st

On August 21st at 3:50 am Tyngsborough Police Officers stopped a motor vehicle on Middlesex Road near the
Tyngsborough Bridge. Upon approaching the vehicle and speaking to the operator an officer asked him to
step from the vehicle in order to perform a sobriety test. A second officer asked the passenger to step out of
the vehicle. As the officer attempted to speak to the passenger he then jumped over the guardrail and then
jumped into the Merrimack River. The subject then began to swim across the river toward National Carpet, the
Tyngsborough Fire Department was activated and put a boat in the water at the Frost Road Park. Other
agencies in the area responded to assist Tyngsborough in retrieving this person from the river; Chelmsford ,
Groton , Dunstable and Lowell Police Departments. As the Fire Department boat approached this subject he
exited the river at which time officers attempted to take the subject into custody. The subject, later identified as
Sean McInnis, actively resisted attempts to arrest him. The subject was warned that pepper spray would be
used however continued to resist at which time he was sprayed. This subject was subsequently transported
to Lowell General and treated for difficulty breathing; he was discharged shortly thereafter and then booked at
the Tyngsborough Police Department.

As a result of this incident the following arrests were made;

Nathan Balakin, 19 yrs. old of Tyngsborough – OUI Liquor and marked lanes violation
Sean McInnis, 22 yrs. old of Lowell – Resisting Arrest and (2) outstanding arrest warrants.
