Sex Offender Registry/Notification


The Tyngsborough Police Department is releasing the following information pursuant to M.G.L. c.6s.178C – 178P which authorizes law enforcement agencies to release information that will enhance public safety and protection. The individuals who appear on this notification have been convicted of a sex offense that requires his/her registration. These individuals have been designated  LEVEL 3 SEX OFFENDERS by the Sex Offender Registry Board (SORB). The board has determined these individuals are at a high risk to re-offend and the degree of dangerousness posed to the public is such that a substantial public safety interest is served by active community notification.

These individuals have served their sentence imposed upon him/her by the court and are  

NOT WANTED BY THE POLICE. 

 

Law enforcement agencies have no authority to direct where a sex offender lives or works. Unless court order restrictions exist, these offenders are constitutionally free to live wherever he/she chooses. Sex offenders have always lived in our communities: but it was not until the passage of this law (which mandates sex offender registration) that law enforcement could share this information with you. Any abuse of this information to threaten, intimidate or harass registered sex offenders will not be tolerated and could potentially jeopardize our authority to keep the public informed.

 Sex Offender Registry information shall not be used to commit a crime to engage in illegal discrimination or harassment of an registered offender. Any person who uses information disclosed pursuant to M.G.L. c 6. s 178C-178P for such purposes shall be punished by not more than two and one half (2  1/ 2) years in a house of correction or by a fine of not more than one thousand dollars ($1000.00) or both (M.G.L. c 6 s 178N).  In addition, any person who uses registry information to threaten to commit a crime may be punished by a fine of not more that on hundred dollars ($100.00) or by imprisonment for not more than six (6) months. (M.G.L. c 275 s 4).

Sex Offenders are classified as follows:

 

Level 1 = Low Risk                                                   Level 2 = Moderate Risk                                Level 3 = High Risk

Level 1 Sex Offenders
Where the Sex Offender Registry Board determines that the risk of re-offense by an offender is low and the degree of dangerousness posed to the public by that offender is not such that a public safety interest is served by public availability, the Board shall give that offender a Level 1 designation. Information on Level 1 offenders will not be available to the public. Neither the police nor the Board have authority to disseminate information to the general public identifying a Level 1 offender. Information identifying Level 1 offenders may only be given to the Department of Correction, any county correctional facility, the Department of Youth Services, the Department of Social Services, the parole Board, the Department of Probation and the Department of Mental Health, all city and town police departments and the Federal Bureau of Investigation for law enforcement purposes.

Level 2 Sex Offenders
Where the Board determines that the risk of re-offense is moderate and the degree of dangerousness posed to the public is such that a public safety interest is served by public availability of registration information, it shall give a Level 2 designation to the sex offender.

The public shall have access to the information regarding a Level 2 offender through the Local Police Department and through the Sex Offender Registry Board.

Level 3 Sex Offenders
Where the Board determines that the risk of re-offense is high and the degree of dangerousness posed to the public is such that a substantial public safety interest is served by active dissemination, it shall give a Level 3 designation to the sex offender. Search for Level 3 Sex Offenders… Click Here

The public shall have access to the information regarding a Level 3 offender through the Local Police Departments and through the Sex Offender Registry Board .

If you were the victim of a sex offense, or you are the parent/guardian of a child victim or the guardian of an adult victim of a sex offense that resulted in a conviction, we would like to hear from you.

The Massachusetts Sex Offender Registry Board (SORB) is the public safety agency responsible for classifying convicted sex offenders according to dangerousness and risk to re-offend. As part of the classification process, a victim of a convicted sex offender is entitled to submit a written victim impact statement to the SORB.

How to register as a classified offender?

 

A classified offender can register at Tyngsborough Police Department. The Massachusetts Sex Offender Registry Boardrequires law enforcement agencies to photograph and fingerprint classified offenders. Photographs and fingerprints are taken Monday – Friday 8:30 am to 4:00 pm at Tyngsborough Police Department on Westford Road , please call  1-(978) 649-7504 for more information.
